Failing To Remove Rubbish Prosecutions

Four people were taken to court by Bradford Council for failing to comply with Community Protection Notices (CPN) requiring them to remove accumulated waste from their property.

Eugene John Lennon and Pamela Holmes were each fined £600 with £340 costs and £60 surcharge after the case was proved in their absence.

The court was told that they failed to comply with a CPN requiring them to removed accumulated waste from the rear yard of the home they shared in Craven Street, Keighley.

Prosecutor Harjit Ryatt told the court that defendants had not complied with the notice to removed domestic waste, wood and litter within the 14 days required time limit.

Russell Yates was fined £660, with £695 costs and £60 surcharge after being convicted in his absence. He failed to comply with a CPN to requiring him to remove rubbish from the front and back of a property he owned in Idle Road, Bradford.

Ishtiaq Hussain pleaded guilty to failing to comply with a CPN requiring him to remove tyres, litter, wood and burnt tyres from a vacant plot of land at the rear of 24 Blythe Avenue, Girlington, Bradford.

Mr Hussain told the court that neighbouring businesses had been fly-tipping rubbish on his land.

He was fined £200 with £675 costs and told to pay £20 surcharge by Bradford Magistrates.

Councillor Sarah Ferriby, Bradford Council’s Executive Member for Environment, Sport and Culture, said: “We have to show we are serious about enforcing the legislation which is designed to help us improve the environment."

“What these penalties show is that it is far cheaper and more sensible to comply with notices issued by the Council to clear rubbish from land for which you are responsible than it is to end up in court and have to pay the costs of the prosecution as well as a fine."

“If you are responsible for an eyesore and don’t take the responsibility to clear it up, then you should be prepared to face the financial consequences as well as ending up with a criminal record.”
